Subject: COMPLAINT UNDER SECTION 5 AND 18 (B)
SUB SECTION-II OF THE NATIONAL ACCOUNTABILITY BUREAU (NAB) ORDINANCE 1999,
AGAINST THE HOLDERS OF PUBLIC OFFICE FOR PUNISHMENT UNDER SECTION 10 OF NAB
ORDINANCE BY ABUSE OF POWER AS A CHIEF MINISTER.
FACTS AND GROUNDS:
1. That the respondent was deeply involved in
corruption of billions of rupees in Defence Housing Authority (DHA), Karachi
Scheme. Commercial plots of 100 square yards each and 500 hundred square yards
residential plots of DHA were allotted to twenty five senior and junior officers
and MPAs at nominal rates.
2. That the residential plot of 500 square
yards of DHA are valued at Rs. 10 million each in the market and 100 square
yards commercial plot in DHA is of Rs. 10.5 million each.
3. That the defendant’s favourites will pay
just Rs 400,000/- for each residential plot and Rs. 600,000/- for each
commercial plot.
4. That the following were benefited :
i. Sikander
Kerio, Principal Secretary to the Chief Minister (CM)
ii. Mohammad Ali Arain, Special Secretary to CM
(an officer of Zari Bank and absorbed in Sindh Government in B-ZO)
iii. Ghulam Sarwer Sarki,additional secretary to
CM (a Zari Bank officer)
iv. Arbab Attaullah, DS Staff to the CM (a Sui
Gas Company officer nominated as assistant commissioner /DDO)
v. Maqsood Ghumro, additional private secretary
to the CM (nominated as assistant commissioner Dadu)
vi. Ali Raza, Personal Staff Officer (PSO) to
the CM (He has been given out of turn promotion).
vii. Aijaz Shaikh, APSO,
viii. Khashkhali, a deputy secretary to the CM.
ix. Jahangir Mirza, Inspector General Police
Sindh.
x. Fayaz Leghari, DIG Police.

5. That if the Sindh Government has any quota
in DHA schemes, then a balloting should be held to allot plots to genuine,
honest and dedicated officers. This favoritism has established a trend of bad
governance and has created animosity among other officers of the Sindh
Government.
The above facts have been published in the evening
newspaper “THE STAR”, Karachi dated 27-3-2006 (Copy enclosed for ready
reference)
1. The respondent in this complaint do fall
within the ambit of NAB Ordinance 1999 for the purposes of investigation, trial
and punishment.
2- The respondent is reportedly guilty
of corrupt practices as a Chief Minister, abuse of power as defined in Section 9
of the Ordinance and as such is subject to punishment under Section 10 of the
NAB Ordinance 1999 based upon the above facts and grounds:
CONCLUSION:
Based on the above facts and grounds, the respondent
has shown willful indulgence in corrupt practices under Section 9 of the
Ordinance. Such a person is subject to punishment under Section 10 of the NAB
Ordinance 1999.
As such the Chairman of the National Accountability
Bureau is called upon to initiate investigation in connection with matters set
out hereinabove and further proceed to file a Reference against the respondent
for violating the provisions of Section 9 of the Ordinance punishable under
Section 10 of the NAB Ordinance 1999, in competent court of law and proceed
against those concerned for violating Section 9 of the Ordinance.

Plots Given To Govt Favourites
Setting
another example of abuse of power and position, the Sindh chief minister has
allotted most valuable plots in DHA to officers whom he has already favoured by
giving them out-of-turn promotions, 'questionable' absorption in Sindh
government and has nominated them to executive position.
The Sindh
chief minister has allotted valuable 500 square yards residential and 100 square
yard commercial plots to 25 officers, senior and juniors, and MPAs at nominal
rates in Defence Housing Authority. The residential plots of 500 square yards
are valued at Rs10 million each in DHA and 100 square yards commercial plots are
valued at Rs10.5 million each. But, the chief minister's favourites will pay
just Rs 400,000 for the residential and Rs 600,000 for commercial plots.
The Chief
Minister House is of the view that the plots has been given to the most
efficient officers from the Sindh government officers' quota in DHA.
The
officers to whom the plots have been allotted are Principal Secretary to CM
Sikander Kerio, Special Secretary to CM Mohammad Ali Arain (an officer of Zarai
bank and absorbed in Sindh government in B-ZO), additional secretary to CM
Ghulam Sarwar Sarki (a zarai bank officer), DS staff to the CM Arbab Attaullah
(a Sui Southern Gas Company officer nominated as assistant commission/DDO,
additional private secretary to the CM Maqsood Ghumro (nominated as assistant
commission/DDO), personal staff officer (PSO) to the CM Ali Raza (he has been
given out of turn promotion), APSO Aijaz Shaikh, a deputy secretary to the CM Mr
Khaskheli.
The police
officers that have benefited are Inspector General of Sindh Jehangir Mirza, DIG
Fayaz Leghari, DIG operations Hyderabad Mazhar Shaikh, DPO Badin Abdullah Shaikh,
SP Traffic.
The
secretaries enjoying the government's largesse are the chief secretary Sindh
Fazal Rehman, secretary services Shah Mansoor Alam, Secretary implementation
Nazar Hussain Maher, secretary agriculture Mahkumuddin Qadri, Member Sindh
Services Tribunal Ayub Shaik.
A plot has
also been given to a Sindh Text Book Board officer and MPA Afshan Imran.
